Good question. I am in the same situation. My GG was approved Aug 6th and happen to attend an interview the same day.
I already used AC21 and may have used it second time for this if GC was not approved. So question is can you switch jobs within day of receiving CG ?
From forum search, it does seem ok to switch jobs. Its hard for me to find a valid reason on why we need to stick to the employer for 6 months or 1 yr.
There are cautious people (to say it right, paranoid people to put it blunt) who will not use AC21 or have the theory of sticking to employer for 6 months or 1 yr.
I am still pondering, but leaning strongly towards switching job if the offer is good.

And what makes you think that software consultancies cannot be run without H1-B visas?
Lol, they can.....and they'll charge like $200/hr for everything w/o H-1s willing to be relocated at moments notice.....the industry can't afford to pay someone higher just because they are 'American' if it is not profitable for them......leads back to the original point....

Not related to this thread but I did not want to open a new thread for this question..
As you can see I am EB2-I (info above) and am waiting in line for my turn but I am just wondering if L1 route to GC is quicker? If so then how?
Not that I am trying to do it because I can not :) but I know someone who just got his GC via L1 in matter of months and here we all EB guys are waiting..

On a side note, I was wondering what happens to derivative/secondary beneficiaries 485 applications if the primary beneficiary is stuck in name check.....If secondary beneficiaries are cleared and primary is not, then does USCIS approve GCs for secondary beneficiaries..

Can you please share why you ported in the same category? Or because of some other reason?

I think MPADAPA' assumption about FB quota usage is not correct and I completely agree with realizeit.

I personally think Mr. MPADAPA's assumption is wrong. Last year (2008), the spillover came from Family quota of 2008. Spillover from Family or Employment quota of a particular year cannot be given to the following year. So the fact that there is nothing left from the family quota of 2008 doesn't change any situation here.
So, this year the spillover that Employment category can get from Family quota will be the unused numbers of 2009 Family quota.
This is just my thought!

I came to US in 1999 and for a month I did not get paid. I switched to another company and they filed me new H1 instead of transfer. From then, every H1 transfer I need to provide lots of documents to attorney and answer several RFE's for each h1 transfer. Being out of status(not illegal) concerend me a lot but now being illegal is the better than being out of status.
Having paid taxes for all the eight years and playing by rules does not help in America. It is so ironical now to see how legal people are digging their way back in time to find a period for which they wanted to be stamped illegal. All these days legals tried to cover up, but they are now PROUD and HAPPY to find such periods. The WORST is the poor fellows who have not even stayed illegal/out of status and played by rules 100%.
GOD BLESS AMERICA. Becoming illlegal is very easy, but if you want to be legal and get the GC, then it this is not the land.

I gets very severe migraine attack almost everyday thinking about the GC !! I took so many pain killers(acetameno) almost everyday ..now they also stopped working on me...and due to these apin killers ..I became acidic ..acidity everyday..even without eating spicy things...my wife says, probably my lever damaged ..don't like to visit doctors ...will it get worse ? I can't escape visiting IV everyday !! Any remedy for me will be highly appreciated....
While a pray for your "lever"....i will suggest u see a doctor asap!!!
And I will also prescribe you channel all the pain into some positive energy by helping IV via contributions, volunteer work...and participatingin action items...all that is very rewarding!!! and will help you from going nuts, bananas and what have you!!

Applied for EAD on Aug 30th, Receipt notice was on Sep 3rd and Got email yesterday saying card production ordered. Nebraska Service center.
Now waiting for AP to be approved. Applied on Aug 30th. Receipt notice on 3rd Sep, LUD on 10th Sep.. Texas service center. Thinking it should not be long.

Most of our jobs are replaceable in today's world. There is no shortage of "skilled workers". So, I for sure cannot take a long leave and wait for EAD to come by and re-join....because my job would be gone by then to some other "skilled" person. And its not easy to get another one quickly and without moving to a different place.

America invites H1Bs and gives them greencards not because they are paying taxes but because employers prove no american is available for our job and we have unique skills for job. 'Best and Brightest' is we are and USA needs us. Without us the economy will be more bad.

I think EADs are sent to the applicant and AP to the attorney...had the same in my case...plus seen lots of folks here say the same thing...
EAD, AP & FP notice are sent directly to the applicant. If you see the status of AP as document mailed then you should get within 2/3 days as they send by DHL. I got mine in 2 days, my wife also got in 2 days

Looking at the .PDFs and the law on spillover, I agree with MPADAPAs analysis. Still hope that there would be spillovers from unused EB visa...sure it will be less compared to last year....but atleast feel/hope it would be enought to get through 2006....atleast for EB2 guys....

I am already using my EB3 EAD to work (I invoked AC21 last year to change job) Can I know how much it costs to file EB2 labor+I-140+interfile process , if my current employer says that I have to pay for it myself (I was given this offer because I told them I did not need sponsorship and I had EAD).
By law Employer is required to pay for your labor. You cannot pay for your labor application. Employer can ask you to pay for your I140 which cost around 400 but if you go for premium processing you can pay 1000 extra. There is no other cost involved. To port your date your lawyer sends a letter to USCIS requesting them to consider your EB2 I140 instead of your Eb3 140 which results in your successfuly porting with your priority date still being maintained from old labor

This time, either this year or next year, we will know if CIR is driven by real Leader's or Politician who exploit any situation to increase their chances to stay longer in power.
Also do not see much media attention to anything related to CIR. May be it an election year politics that drive things now !!!
If this law suit translates into some action to address this broken immigration system, then it is a good one !!! Will have to wait and see ....

Can you call up the customer service to know your status as to whether you are pre-adjudicated or not?
As per this everyone who got pre-adjudicated would be receiving their GC in FY2010. But, there are people from EB3I with PD as late as 2007 who got RFEs recently and got their cases pre-adjudicated( I am one of them even though my PD is March 2003 and when I called up NSC, they said my case was pre-adjudicated and waiting for a Visa number ).
With EB3I staying at 1 Nov 2001 when the new FY2010 quota starts in October doesnt match to what Ron Gotcher says.
Anyone have any opinion?

I left my previous employer more than 6 months back , he didnt paid me my final paycheck and i complained to DOL since 3 months...now wehn i asked for my W2 he said me to do whatever i feel and he is adamant at not giving it....moreover he said that his company has suffered losses worth 25K and his lawyer has sent a legal notice in this regard....and when i said how will we file taxes he says he wished for me to be out of status and go back.....
Since i have complained to DOL and also it is more than 6 moths since i left his organisation giving proper notice and have email confirmations, can he issue me legeal notice.....?please advice...
He is also saying that he has written to USCIS that I am fraud,....though I have been working in fortune 100 companies and now also working in reputed company and never lied for anything and was on project from day 1 since I came to States....? can USCIS cause problems for me in future...
Also, he seems to have closed his company..
Folks please advice....
