    Though the website says sold out, I called just now and got a queen room for 109+tax for one night 17th. Thanks for the help.

    I just called and the guy said he has the room ; he then started taking all my information and finally asked when I would arrive. I told him on 17th, 7:30am and he said " oh sorry we don't have any room, I thought you wanted it tomorrow"

    So check it up again.

    Also, if your room has 2 beds, can you share the room with me? We can split the bills and I needed a company too. I am trying to book a room but so far no luck. I still need to book a flight too. I am flying from Oakland on 16th night. Thanks

    Very good point logiclife. what happens in this following scenario when 140 is approved and when 140 is pending.

    Person X has completed 180 days after 485 filing, used is 6 yrs of H1 and now he got a 3 yrs of H1B from the same employer. If this person uses AC21 & EAD and joins another company and after 1 yr his 485 is rejected for wrong reasons, will this person be out of status(since used EAD) or will be in status since his H1b is still valid with the old employer (Assumed the employer has not revoked). Will it be safe to come back to the same employer.

    I dont think that after using H1 for 6 years, you can switch to H1 status from EAD status once 485 is rejected. Now, if you have used less than 6 years of H1, and then used AC21 portability, used EAD, abandoned H1 status and continued on EAD status and if the 485 gets rejected, there may be a way to reclaim the remaining unused portion of H1. It may involve going out of country and coming back in. Check with a lawyer, I dont know much and haven seen any case where someone who was on EAD status could go back to H1 status. Usually H1 to EAD is a one-way street, especially if you have already used up the 6 years of H1 stay in country.

    Well, in that case you become a ulta employee and trouble your employer...

    NKR, not sure if you heard about this one proverb... "jabh kismath GA***U hai tow kya karey ga PANDU"....we unfortunately get trapped with such type of employers who trouble their employees and learn lessons in hard way and looks like you haven't encountered any such experiences with your employer, if that's the case you are lucky enough & I wish you would NEVER fall into such employers hands who would trouble for so many other different reasons and this could be one way....or not sure if you should have one small experience and see how you feel just for the heck of it....

    I can sit here and add as many proverb's here all day long but the point here is try to be supportive to folks who are seeking for some help rather then sharing your "KATARA" proverb's..try to improve your thought process if you can....

    you mean there is no freedom in India??? 80-90% of the indians who have H1 have not attended college in US and do you think these people are not educated and knowledgeable. I think you should grow up man... or might be when you get sick and get admitted in hospital and your insurance doesn't cover... you realize the importance of India...

    US has its advantages... India has its advantages... just because you are in US now doesn't mean you can talk rubbish about India.... If you like US, talk good about it... but you don't need to de-grade one country to highlight another...

    makes sense.... every place has + / -

    in US: if you have proper source of income it looks very green, if not deep blood red
    in india: it does not go very green or too red...but since last 10 years..cost of living in cities have just skyrocketed, which i feel could lead to "very green" or "deep red"

    Forget Polls. Polls are no way going to help any one. If people are complacent that they have filed for 485 and can enjoy the ride they are mistaken. If people are worried that their receipts havent been generated in 60 days, they are unnecessarily worried.

    If all the people in the DC area who are affected by this participate along with their families, we have more than 10,000 number. As paskal said, my job my vacation, my manager, my time off, my, my ... my. I am talking with people and I explain them. I get a weird response. What can I do? I filed for my 485. I will get my EAD & AP.

    I ask those guys what will you do if the economy tanks in Dec/Jan time frame and you lose your job? All the hard work you have done in your job for the past 6-8 years, your manager and nothing comes to rescue on that day.

    Its our choice. Its in our hands. Its in our minds to make a decision to actively participate in the rally.

    Call your friends in DC and wake them up. Let them cuss at you. Dont give up. Dont give up

    I hate to see you leaving, you need to fight for others. Who knows somebody close to you might get stuck in this mess. IF everybody leave just because they got what they need than its not fair. If you think IV has helped you in any way then each of us put some effort to help IV and its members.

    He is ***ing desi employer and is counting on me as if he has to take some personal revenge..please kindly suggest all available options..?

    Can i file my taxes thru HR block on basis of his paystubs(and checks) and bank statements?

    I came here in 2000 through a desi consultant. After landing, he made me a sign a contract that i won't leave him within 1 year or else i need to bear fines ( he didn't tell this while giving offer letter in India ). Then later he kicked me out after 1 year ( because of bad time there weren't much projects ).

    I understand you don�t care about the United States and its people and you�re only interested in what you can gain from them but if you weren�t so blinded by greed you�d see this is something else they can give to you. Now I know why I took the route I did, I would have accomplished far less in my personal life with the likes of you. In fact, I may doing to much sharing my expertise with you. I refuse to have my name tarnished any further. Besides, you�re only a beginner. What was I thinking? IV really ought to make it clear to everyone that this is an amateur site. Maybe by changing its name to Beginning Immigration. IV definitely is not the voice of Immigration � my voice is different from IVs and I�m dealing with immigration.     my case is quite funny.
    Applications went to texas service center originally.
    From there they were transferred to California where they issued my EAD and AP but transferred the application back to TEXAS.

    Oddly enough the only thing that i initially got in the mail was a transfer notice and the ead cards. I didn't get the receipt notice, the AP or a FP notice?????/

    Any Idea whether anyone got ead without FP?

    Same with my case too. Got receipt notice only for my 485, No RN for EAD/AP and none for my wife. but received the transfer notice from CSC, case transfered to TSC and also received EADs.

    Check with your attorney, they might have the receipt notices. In my case, they did have them. Also AP shows as approved, not received it yet and no updates on FP yet. Hopefuly will get soon.

    Has anyone thought of the people who missed the august 17 deadline because the labor was not cleared within time. Because of no mistake from ourside, we have to suffer. What a screwed up legal situation ?

    As of now PD is apr 2001, I dont know when will it move ?

    Sorry to hear about your situation.
    The one consolation is that once you get to file your 485, you should not spend too much time in that pending 485 situation.
    So if you ask me today, would I rather have filed 485 with a PD of 2006/7 or be in your situation, as bleak as your situation looks today, the better choice might be your situation.

    Yes, but you are missing the one important fact, that "band aid solution" would put band aid to thousands of hurt people which will sooth them for a while. I understand, your 485 is already in pipeline so you already have those band aids but claiming to be sorry portrayed you very selfish. Think about teh group then you will slowly start forgeting your sorriness.

    I said earlier, its not a bad thing as it will bring relief to some people. However it will also make it tough for anyone else after July to get 485 becuase of the huge back log.

    I am not thinking about only myself. I am thinking about all of us. I am not enthused becuase I dont believe the decisions are not being made genuinely in our interest. They are doing the politically correct thing and not the morally correct thing.

    Does this (given below) means DOL has the authority to find something and send Notice of Intenet to Revoke at any point of time during the GC process?

    "The DOL Perm rule, at 20 CFR 656.32 provides for the revocation of approved labor certifications by DOL if a subsequent finding is made that the certification was not justified. In such instances, DOL provides notice to the employer in the form of a Notice of Intent to Revoke an approved labor certification that contains a detailed statement of the grounds for the revocation and the time period allowed for the employer's rebuttal. The employer may submit evidence in rebuttal within 30 days of receipt of the notice. If rebuttal evidence is not filed by the employer, the Notice of Intent to Revoke becomes the final decision of the Secretary. If the employer files rebuttal evidence and DOL determines the certification should nonetheless be revoked, the employer may file an appeal under 20 CFR 656.26 within 30 days of the date of the adverse determination. If the labor certification is revoked, DOL will also send a copy of the notification to USCIS and the Department of State."

    How does this memo affect the AC21 portability if an approved labor cert is revoked? This also raises the question: Since the PERM cert is only valid for a certain period, can it be revoked after its expiration date?:confused::confused:

    REDUCTION IN WEIGHTED AVERAGE
    The increase in actual costs to applicants and petitioners will be only 66 percent, however, because applicants for adjustment of status will no longer be required to pay a fee to apply for interim benefits.
    Currently, the I-485 fee is $325. The I-485 customer will also file an average of two Applications for Employment Authorization (I-765) and nearly half will file at least one Application for Travel Document (I-131), while an additional 20 percent of applicants will file a second. These additional ‘interim benefits’ applications allow applicants to work or travel while their status application is pending. The combined fee that applicants currently pay is approximately $800. The proposed fee structure will eliminate the need for applicants to have to pay these subsequent fees that result from processing delays. USCIS is proposing a $905 fee for the I-485 form. When considering the interim benefit fees paid by applicants, the increase for the I-485 is $105 instead of $580; therefore, the overall weighted average is reduced to 66 percent because adjustment of status applicants will pay approximately the same fee that is currently assessed when taking into account those associated ‘interim benefits’ that are paid over a multi-year time perio

    Dear friends, why do you seek to start bashing your country at the first opportunity you get. THere are people in the Indian Govt who are negotiating on your behalf to make sur you get your money back.

    THen on the question of paying bribes to get money out of PPF - something is better than nothing. Why complain. If it is so bad, go back and fight to fix the system, otherwise stop maoning. India is the only country that will welcome you if you are kicked out of here. I remember i used to pay 50 INR per ticket for a railway seat, now i go online and book a ticket. Things change they take time and patience.

    Only those people who have NEVER bribed anyone to get stuff done illegally, or out of turn should speak. And i know there is no one, since you are in US and came on a passport and we all know how passports are obtained.
    You left india, want to stay away, so leave it alone. When you are kicked out of everywhere, the doors will still be open, just keep some cash for the gatekeeper.
    Lets discuss whether this swap will be possible or not, or what the loopholes are.
