I am not sure whether should I consider myself under EB2- Jan 2004 or EB3 Jan 2004. Because, I didn't get any confirmation of the case interfiled. Of course its just this week that lawyer that initiated the interfile.

my non-lawyerly suggestion: do not file ac21 until well into whichever job you takel
I have read on various forums that there is no necessity to notify unless there is an RFE, but to maintain appropriate evidence at all times. you may want to consider doing that until you are well settled in whichever job you take.
by the way, what is your PD?

I have a pending AOS (I-485) application
filed by my previous employer (company A). The I-140 is approved and is well
past 180 days. I moved from company A to company B in late April
2008. They did an H1 transfer and filed for AOS portability under
AC21. I did not like the role there, so had planned a move to Company C, my current employer - again H1 transfer and AC21 (yet to
be filed). Just before I moved, I got another offer from company D
(which I believe best fits my long term career interests). I would've
avoided the hop to company C had I not given the notice to leave at
Company B. Now, I am looking to move to company D at the earliest (perhaps in a month). I have
been at company C for 4 weeks now.
Question:
Should company C file an AC21? Since there is already an AC21 on file (by
company B) and if I will move to company D, can I reduce one additional AC21
filing? This is just so that there aren't 3 Ac21s filed and to avoid
making me look frivolous. Please advice. If its safer to file it, I
can request an AC21 filing soon from company C.

Filed at NSC on July 2nd 2007. Got EAD/AP approval notices and receipts/transfer notices from CSC last week. No FP notice yet.
There are several in my company in the same situation..NSC->CSC and now CSC Xfr'd back to NSC. No one has rcvd FP notice. I think August 17th filers at NSC are ahead of us now and we are at the tail of the queue one more time.
The only advantage of CSC transfer is if you need EAD/AP desperately. if you don't then it's just bad luck.

Take example EB3, how you think will look like EB3 on the next visa bulletin without country limits. EB-3 probably will be June 2002.:eek:
Guys we see a very unhealthy trend here where any disagreement is not tolerated. This forum is for legal skilled immigrants and we sometimes show how unskilled we are when it comes to tolerance of opinion here.

The data itself shows that the overwhelming number of skilled immigrants come from India/China. If the objective is to let the most skilled immigrants in, then the US should forget about diversity. Unfortunately in terms of volume and talent combined, India and China handily beat the rest of the world. Even if EB3 goes to 2002 so be it, but at least you are treating all skilled immigrants on a level playing field rather than discriminating them based on where they were born. If the US continues to do this, there is a serious danger (and this has been documented) that skilled folks in India/China will no longer find the US attractive. Its already happening with the economy booming in India. In fact, we'll probably see you or your kids standing in line for an Indian or Chinese green card in a few years (and I doubt India or China will focus on diversity when it comes to attracting the most skilled talent).

a) Republican base is not you and me, in case you haven't noticed they either cater to big biz or to a specific "kind" of Americans.
but that specific kind is now the majority, the senate seats they lost are because of the extreme views of the candidates
b) Tea Party is basically opposed to many things including free trade and immigration. Like any other politician they might change when they have power, if they don't then hope things don't get worse.

c) Nikki Haley and Bobby Jindal don't represent us, they are American for all practical purposes. If anything they have distanced themselves from any indian heritage in their campaigns. Nothing to expect here.

For those in the Bay Area: Have you contacted the new Indian Community Center in http://indiacc.org/Default.aspx (they have locations in Milpitas and Sunnyvale)? I don't live in the South Bay, but it seems like this is a pretty active space. Wonder if they would let us give a talk, and/or post flyers etc. If no one has been in touch with them, I could try.

Thanks. she is still working for the same employer who sponsored her H1. Now, she needs to continue maintaining relation and continue working for them.
I am still worried though.. I read in this and other forums that USCIS may issue RFE asking for proof and if says medical leave, then asking for medical records etc.. So, better to prepare for some 'solid' answer with out any loopholes by being honest. I do not think lying would help and may lead to more troubles.
It means, if at all they have any doubts, they may issue RFE, but if you have a good relationship in responding to those RFEs using company letters etc, there is no problem. Good relation means, employer has to suppprt you always in case of any RFE, thats it. He needs stand on your side. Then there is no problem. But if he won't stand on your side, then it is a problem. So, thats why relation with employer is very important when on H1 or EB.

May be you are right....but, I feel that the whole thing is a broken promise. And I feel like I fell right in the trap set for people like us.

Disappointed ..... definitely YES, having realised the follies of the "system" here. Search within yourself to find out how / why you came to this country first. Was it just a lure of the GC ? Most of us either came to study / work. We took it one step at a time, but GC was not the only or ultimate goal.

Over 60% of the US and 90% of Arizona supports the law they passed. Obama and his Attorney General are doing the wrong thing by interfering with state politics. How can these high ranking officials tell state law enforcement NOT TO enforce laws? The Supreme court will favor AZ even before the case starts. Slam Dunk.
those numbers.... 60% or 90% are all doctored...... and i'll look at the poll numbers only if both the following conditions are true -
1.) if i've no brain of my own to differentiate between right or wrong, so i must rely on the poll numbers to help me choose my position
2.) if i'm a cheap bastard running to get elected in some useless office ..... therefore i must do what is popular than what is right.... i must give up my conscience and i must choose my position looking at the poll numbers......
i'm afraid that neither of these two conditions apply on me..... so i'll have to disagree with u.....
so much for u'r slam dunk...... come back and read this after the decision by the US supreme court...... state of arizona does not have legal jurisdiction over federal immigration law. no matter how much evil we see around us... this world is made up of good men and women..... AZ will lose..... federal government is asking AZ to enforce the existing law and disband their illegal & illegitimate bill sb1070 becoz its in violation of the constitution of the country..... applying existing federal law will take supremacy over "AZ immigration law" ........
