Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

As far as I know you do not need to get a new visa stamping. At least, it was like that when I was on F-1. What you need to re-enter is to have I-20 from new school. Check with the school's international students adviser.

Hi all,
When started working for Company A it used to operated from 2 diffrent locations Newjersy ,New hampshire (Excutive office).
My Company applied Labor from NH in March 2005 (before perm).6 months back my case was moved to New York regional center ( i am not sure why it is moved to NY insted of newark NJ).
Recently they closed (in April 2010) the NH Branch .
What will happen to my green card ..? (labor is applied for NH location)
When i check with my employer he is saying NH location is Executive office it will not have any impact .
if reuqired he is ready open office in NH with new address
What should i Do...? i am totally in confusion state .. and now my dates current from july ,2010.

New filing fees were applicable from 7/30. Do all applications(485/131/765) whose PD is current need to filed with the new fees starting from 7/30? Or till 8/17 it can be filed with the old fees?

Effective July 9, 2010, the Department of State revised its visa reciprocity schedule for China to allow for a 12 month, multiple entry visa for H visa applicants. This will allow H-1B visa holders from China to have multiple entries into the U.S. for a 12 month period. One of my friends has been unemployed for the last 6 months but his AP and EAD are current. He needs to go to India in June. Will he face any problems while coming back into the country? Should he postpone his India trip till he he has been on a job for 3-4 months? If he starts his own company and gets a salary from that will it cause problems? Also Newark is his closest airport. Is Newark OK for AP or should he try Philadelphia or JFK in New York?

Her court date is on 30th July in texas. I need help to find a good immigration lawyer for her. Could you guys please suggest me immgration lawyer (if possible Indian) there, so that I could contact asap. TIA.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.
