They asked the biggest takers of H-1B visas. They just so happened to be Indian companies, funny enough.
I don't see why you would think of the bill as insane. It weeds out the abuse clogging up an otherwise great visa program.

been 90+ days no news on AP. called USCIS for delay and now I get an email about RFE on me and my wifes AP.
any ideas, what type of RFE's being issued for APs?

I do not know how feasible this is, but if in your employment letter, there is a description of responsibilities, and additionally a statement like: "The job being offered to XXX falls under O-NET classification 15-1031," then you are completely covered, because the employer is positing that the job being offered to you falls under that classification. Again, don't emphasize technologies etc., just the job description and mainly classification.
The AC21 language is very clear: "same or similar occupational classification"
It does not say job responsibilities or job title. These are interpretations of that term and used to DETERMINE the occupational classification. So as long as the occupational classification matches or is similar, you should be fine.
Also, the O-NET classification is from SOC which stands for "standard OCCUPATIONAL CLASSIFICATION." It can't get any clearer than that :-)
As always, my cautionary statement: I am not a lawyer, just applying common sense interpretation to the terms.
In that case, both my old and new job (responsibilities and titles) fall under 15-1031.00 if we take into consideration a broader classification where job duties are the same but technologies are probably 60% same but some technologies mentioned in my L/C are obsolete and my current employer does not list those technologies.

Initially I too got the same doubt that it could be a prank from my friend. But the name of the person who called me matches with the name of the person who visited my employer's office around 2 months back. After I got a call from ICE officer, I notified the same to my employer and explained about the call.
Really donno what to do.... Even though the ICE officer took prior appointment for visiting me, should I still contact attorney?
Don't let him come to your house w/o your attorney being present.

Highly recommended especially, if your company pays for it (mine did not)!
I know lot of us have tough schedule but this bill will get rid of large pool-
I would think 30-35% - Why? Lets see EB1's are definitely out- Plus most EB2's (except Bachelors + 5 yrs exp guys) will be out.
Don't give me any Red dots over this- Just a humble opinion. So, lets says it gets rid of 30% in queue, it's as good as Increasing visas to 182K!

My husband did his PMP Certification on his own.. he used a couple of pmi guides that he bought from amazon.com in addition to the PMBOK book. he worked on this certification for 3 to 4 months and passed it. It is possible. It is quite useful according to him if you want to lead teams. No need to spend money on this training.

I have only 1 CG application and no question to interfile (read jealous:)), but after reading this thread, one my co-worker also from india asked this.
She is waiting for GC for more than 5 years, has 2 different I-140s. But should she go for interfilling? Let me ask this question to fellow sufferers.
Our company lawyer never answers question in details, and is not responding on this. She will have to send directly to USCIS in case...
First I-140 - Company A - EB3 - PD July 2003 - approved June 2007 - nothing further, she has the copy of I-140 approval notice though.
Second I-140 - Company B - EB2 - PD Jan 2006 - approved April 2007 - currently filed in july 07
Even after so much begging, the lawyer refused to entertain her and did not asked for PD transfer.
Her husband is working using EAD since last year, is not in H4 status anymore. This is why she is extremely cautious and not taking any chance with her pending I-485. (afraid to interfile all these days.)
What can she do now? I know her EB2 is current as if August 2008, so that is another factor to consider.
Thoughts?

PMP is a certification and is merely to Project and People Management. MBA is a Graduate Degree and pertains to Business Management. One cannot and should not compare a certification to a Degree.
In several responses people have compared MBA and PMP, I don't these two are comparable. Any thoughts?

If you have current AP, you can travel while your AP renewal is pending. AP renewal will be from the date when your current AP expire.
In other discussions it is mentioned that if I-485 is pending & you are applying for renewal you don't need this letter.
BTW, i just read this in the I-131 instructions, so if i hold a valid AP now and apply for renewal and go to India and enter back using the existing AP, does it mean my pending I-131 renewal will be abondoned? :confused:

Now how does that makes me an anti-immigrant :mad: :mad: :mad: . I am ofcourse happy that so many of my friends here are going one step further in getting GC. Something is better than nothing. But, suddenly more than 1/2 mill people getting EAD will have some effect on the market. People(on H1B) loosing jobs after 3-4 months may find themselves in a difficult situation to get a job.
I am on H1B myself, how can I ever be an anti-immigrant ?:) :) I was expecting a little bit more permamnent solution and not a band-aid solution as somebody pointed out.
