Hi,
My wife and I both have EAD and AP. My wife is derivative on my 485 application. I am using H1b for employment though, while my wife is using EAD for employment.
We are planning to travel to India. I am going to continue to use my H1 b as I am going for visa stamping on my trip to India. My wife will be using AP for reentry.
Questions:
1) Do you see any complications while reentering in this scenario either for me or for my wife since I will be using H1 visa and she will be using AP.
2) Does she need to carry her employment verification letter since she is derivative of my application? Can the IO at poe entry ask for her employment? What should she be saying her purpose of visit or any such questions? Would it be ok to mention 'pending AOS' as the status.

Dear Members,
Recently my husband had received an RFE on I-485 requesting information about his employment verification letter. He had sent all documents back to USCIS and today, I saw an update on my case. The message read that case processing resumed and there will be a decision or update made in 60 days.
Do you know what kind of decision they usually make? Is it normal to have such statements written up for a denial or approval?
Any words of comfort would help. My husband is the primary applicant.

I applied for my I-485 September 2008 and have had EAD for more than a year now. However, I got married in Feb 2009 (after my 485 application) and never had a chance to add my wife to the application (she's on H4).
Now, I really really want to change my job (not change of role/title, just change of company).
How does it work if I change companies now? I don't want to or rather can't use EAD since that will make my wife's status invalid. Now, if I am to get a H1B transfer, what happens with my GC application given I already have my EAD with the current company??

I applied for H1B extension - receipt date December 23rd, 2009. Upgraded to premium on January 21, 2010 (Jan 21 date updated in case status on USCIS website). Working as full-time - (empoloyer is not into consulting), Extension is for 3 years beyond 6 years, I-140 approved.
Also, anyone know how long does it take these days for extensions under Premium processing to be approved.

Hi,
I am confused with AP expiration date.
The printed exiration date is :July 29, 2009
But my latest paroled stamp on AP it is : Dec 05, 2009.
Which date should i follow to renew my AP?

Go by original printed exiration date. Someone confused with this . He has to reapply for the green card.

Hello,
I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

My parents are planning to apply for visitor visa. My aunt (dad's sister) has applied a immigrant petition for him about 4 years back and it is still in process. If my dad applies for a visitor visa which is non-immigrant intent, will he face any issues with issuance of visitor visa ?

Guys,
I filed our AP & EAD on August 10th with proof of 485 filing/delivery confirmation.
We got our receipt notices for AP 131 but unfortunately they have rejected our EAD 765 for incorretc filing fee of $180.
They written a notice saying the correct filing fee after July 30th is $340.
But for July VB is'nt the filing fee $180?
I have got back my entire documents packet for 765.
What should I do now? Should I resend the packet with a letter saying that I come under July VB? or should I send a new check for $340? Anybody gone thru similar experiences? Pls help.

It all depends if your I-140 has been filed and approved and the I-485 has been pending for 6 months+.
If your I-140 has been approved and six months have passed since the filing of the I-485 then you should have no problem working in the same/similar job capacity under AC21 provisions.
Having said that, I don't know what the USCIS would do nowadays given the really bad economy.

Hi All,
I have I-140 with PD of 2004 from previous company. From the current company I had started new GC process.
a) Previous labor title is software engineer. New labor title is Computer support specialist.
b) New perm process just started and job order has been posted last month.
In the job order company didnt give much details and only one sentence which is related to the old labor job description though it has 8 lines describing the job description
c)Should the above be a problem for porting the PD? Also current company has not done the sunday ads. Can they include all 8 lines describing the job description in the sunday ads?
d)I am in Viriginia and which sunday news papers do you recommend(EB2)
category.
e) Is there any PERM filing fee ?
