I filed a G28 to allow me to represent my wife. I did not use an attorney. If you are filing for more than one person then I think that a G28 is worth it. It is a trivial form.

I came here on F1 and i was on F1 when we applied for 485.
after i got my masters i did not apply for opt and used the EAD card i got through 485 for working.
I changed my status from F1 to H4 once i graduated.I never traveled after i came here.
Will i face any problems in future when our pd becomes current.
Our lawyer says there should not be any problem but i don't know if he is correct.:(

Guys: This has become a major problem at every place. If we do not take any action, every one of us will be replaced by these BIG outsource companies with L1 and B1.
I already reported this to ICE about violations of CTS which has placed their L1's at client's place for the past 2 years. And still they have several people.
You may not believe their pay. I do not want to put a number here and it will be a shame on CTS for misusing L1. They replaced 18 American Workers at my client's pace. Whatever you guys might think, this is a FRAUD.
As you are a very active IV member and helped with so many campaigns. I would request you to take an additional step towards resolving such issues.
(1) Voilating the law is not right and we must all be against it
(2) If you are concerned about L1 fraud - please make a case by writing a detailed document.
(3) Gather people who think their job is at threat because of FRAUD and form a group
(4) Talk to lawyer and seek opinion
(5) Understand the process and collectively report to appropriate authorities to take action
(6) Talk to your law makers
(7) Run a strong campaign on IV- gather support from other organizations etc..
(8) Keep everything open - like posting everything on forums and nothing to hide.

For more information, we went to visit our home country and re-entered from JFK with no issue twice after 2004. We got H4 tranfered, EAD advanced Payrole too with no issue al all. Looks like "nunc pro tunc" is the solution according to Murthy. Anybody has experience with "nunc pro tunc" please post your experience. http://www.murthy.com/news/n_nunpro.html

I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.
I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

Either employers think EAD is the student EAD which needs to be converted to H1 or they are ignorant.
My suggestion would be to not bring it up....and if it does come up tell the employer that you have work authorization and that the employer doesn't need to do anything. If that doesn't work, then someone is actively discriminating...

I am not aware of anything that says that you need to bring this up initially in your job search. I personally wouldn't put it in my CV.
Apply for a job, as you would if you had a green card (keeping within the AC21 parameters.) If the question of visa sponsorship comes up then you can say you do not need it. I am not sure why people bring this up with their prospective employers. If you have employment authorisation, you have it, it is not employer specific, it is not site specific, it is quite broad in its scope. The employer
has to complete the I-9 like for anyone else. Any issues would be with the USCIS at the time of adjudication and that would be if AC21 rules are broken.
I think that sometimes we project our own fears onto employers and make issues when none exist. I've seen the same sort of doubts expressed about AP travel.
Folks need to grow more confident generally. For many their immigrant petitions 140s have been approved and their 485s have been pending for quite a while. They give you these interim benefits for a reason, so you can use them!

:confused: I have been advised by my lawyer to not apply for h1b extension anymore. I am now on my 8th year. I had my finger printing done December 2006. I also got my EAD valid for 1 year and also have my advanced parole just in case I will have a need to travel. What is your advice? My My 7th year H1B extension expires next month in March, 2007

i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

PIMS is an electronic report generated by DOS�s Kentucky Consular Center that collects nonimmigrant visa petition approval information from USCIS. PIMS contains data on initial petition approvals and on L blanket petitions that were approved in 2004 or later. PIMS does not contain information on approvals of extension of stay or changes of status petitions.

Actually you should consider yourself in the same group as these so called stupid people, cannot exclude yourself as a smart person just because you did not take an ARM. Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.
You are not the only one who thinks this way! Do you want to stuck with your house...paying 600k mortgage for 300k worth house? It is stupid people like you who would, I won't!

Actually you should consider yourself in the same group as these so called stupid people, cannot exclude yourself as a smart person just because you did not take an ARM. Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.

Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.
