I think it would be fair to split the leftover numbers the same way they split whole year quota.

50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?

I'm wondering why you ask this question. It's not your or my perception of "fair" that will drive the DOS or USCIS but the letter of law. The law is not easy to change but the interpretation of the law which shows up in the US Code (USC) can be changed. Therefore the DOS changed their interpretation to match the INA better and my or your perception of "fair" will not change anything. On the other hand it will only lead to heartbreak and destructive discussions that lead nowhere.

I guess we'll need to ADD to that number:
    1. BEC stuck folks who could not file in July 07
    2. PERM approvals starting August 07

to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.

If I have to guess-- (1) would be very less, may be 100-200 max
    (2) around 5000 ( just a PUMA)
    So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.

If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

I believe you dont need to multiply all of the 485 by 2.1 as already applied I485 will include the family?

can you please let everyone know when was your H1 approved? (that will help decide the pattern for passport delay due to PIMS..)

My H1 extension and transfer to a new employer was approved around Feb 2007 and validity is between mar 2007 and feb 2010.

So did you guys notice a pattern here ?

We have no idea how many are legally porting from EB3 to EB2. I am sure many are trying but the data is not available. I dont know how you will move forward without such information.

(Disclaimer: i am EB3 with US masters and no desire of porting to EB2)

Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.

This is plain stupidity. These employers should first take a good look at an EAD and a GC. As far as work authorization is concerned, both these cards provide us with the same rights. The EAD says “The person identified is authorized to work in the US for the validity of this card” where as the GC says “The person identified by the card is authorized to work and remain in the US”.

So why does the legal department come into picture here? Is it because of the expiry date associated with EAD’s? If that’s the case even a GC has got an expiration date (a later date maybe). Does that mean that an additional budget is required to hire GC holders?

Getting any sort of data out of any of the immigration agencies is often frustrating. Especially something like how many eb2 I-140 did they accept, approve, deny... However, they do randomly throw number out and we can scavenge through them for `clues'. Here is one such link.
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/index.cfm?formtype=7&office=5&charttype=1)

    I agree, thanks.

My lawyer recommends to do independent filing without the spouse. He says you get 2 bites at the apple. When the dates becomes current,USCIS won't adjudicate immediately. We have time to add the derivative spouse later on.

Making AOS filing is not acceptable to USCIS and may trigger personal interviews and confusion. He also said take the spouse approved 140 and do an addendum to the 485 saying he/she is doing an independent 485 though we are married.

I just spoke to customer service .they mentioned all cell calls to india are free under this WORLD plan.who ever is signing up , can proceed , can call customer service to confirm this as well to avoid any surprise charges

    bestofall - is right.

Even I am chatting with the customer rep, I have asked many questions about the artes and every time the rep said there is no charge for INDIA, we can call any type of network which is absolutely free.

Please see the below few key replies from the chat person

    --------------------------------------------------------------------------------------------------------
With Vonage World, you will have unlimited calling to landlines and cell phones in India.
That will include all types of phones and numbers,

You can only see that the chart displays the rate per minute that you would have without Vonage World plan. We do still have plans that do not include India for free therefore we need to keep the list specific to clarify the rate per minute without Vonage World.

I can assure you that with Vonage World, ALL numbers in India will be included with no additional rate per minute.

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.

    Guys,
This is one of the key reasons why we are not successful in our mission. All we can do is "lets kill H1/L1 so I can get GC", "lets not worry about EB3 as long as my EB2 is fine!". The only way we can make any progress is to stay united. Lets not try to find carrots that would really be sticks on people who are also part of this cause.

Thanks for the comments...I'll personally come and see you off at the airport when you are ready to leave. I gusess you have your bags packed already.
Just so you know we are not begging for GC we've earned it.
    Hello all
I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??

Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????

My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Isn't it a shame on us to go for Rally to get GC?????:D

Just think that you will get it when time comes, otherwise pack up.

Please don't take much tension as life is very short. I am assuring you all, nothing will happen with law suit and flower campaign.Don't irritate USCIS by doing all this please.

    ****************************

    1. Rolling_Flood, with this temper I am sure you are going to piss off your lawyer with whom you would be working (if at all you do..) on getting portability removed.
    2. if you don't like this thread stay away from it. Lots of people disagree, that does not mean that only people who agree with you can post here. Also, how will I know if I am going to like the thread or not without visiting it?.

    NKR Dude,

    I give you a green.

Some guys dont have the guts to come out openly in the forum to accuse us because they know that they will be banned by moderators. They just give us red dots and call us all sorts of names like moron and ....... in private.

Everybody has the right to disapprove a post but they have no right to use bad language.

Hope these guys understand this is a forum for good cause and they are misusing it.

    LETTER TEMPLATE #4

    Dear Mr. President:

I came to America in pursuit of opportunities, educational and economic. I have stayed here <<<NUMBER OF YEARS>>> years, received a graduate degree in <<<FIELD OF EDUCATION>>>, contributed positively to the <<<INDUSTRY OF WORK>>> industry, bought a home and become a part of the society I live in. I have found that the US economy yearns for my skills as a <<<JOB TITLE>>> and would like me to stay and contribute as a permanent resident. Yet the US immigration system has failed to reconcile with this need. I stand in line to become a permanent resident in the US and face a decade long wait before my turn will appear. The specter of such a wait poses a question I have to answer soon. Do I chase my dreams as an innovator in another economy, unburdened by the indignity of a decade long wait? Or do I shackle my aspirations for the future promise of a life in America?

Mr.President, I believe you can remove the burden of difficult choices these questions impose by helping me believe that America welcomes and values my skills, talent and aspirations. You can help rekindle the hope that that I can wait for my turn without compromising on my right to a fair and dignified immigration process. Mr.President, you can restore my faith in the immigration system and in America by implementing administrative reforms to:

    * Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
    * Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
    * Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
    * Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
    * Allow visa revalidation in the United States.
    * Reinstate premium processing of Immigrant Petitions.

The above reforms are simple and yet can have far-reaching effects on my life along with those of a half million others. These are urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.

I thank you for you attention to this matter.

    Respectfully,

Fraud must not be tolerated for any reason. I endorse the actions of the OP in bringing these violations to the ICE, despite all the whiners on this forum.

The primary reason for all these violations is the greed for money. Whiners, this is not a case against the L1 creatures or immigrants. This is against greed, corruption and injustice. So quit whining.

As per my understanding it seems that these 12000 visas are coming from the first 6 months of the EB1 under usage only and there is a good change that we might get another 8000 to 10000 EB1 visas fall down to EB2 in next 2 quarters. Please correct me if my assumption is not correct.
