    You are absolutely right in your thinking. It is a pity. I know people who get approved forget everything thinking that "All is well that ends well" but the fact remains that USCIS was is and will remain the most incompetent and irrational organization on the face of earth....

    You are right congressional inquiries are being treated as normal inquiries and they are given standard responses and I have bought this to the notice of my congresssman's office....

    I too have the same feeling of Govt's healthcare plan....it'd fail just like SS and Medicare.....

    we got approval on our I-485 (PD Jan,2006).
    I take this opportunity to THANK IV ans its Core Group for doing this wonderful service to EB Immigrants community.

    Mine is April 06- EB2 india. Got RFE. and answered on 29 sep( Received by uscis - 30 Sep) .
    When we can I expect approval?

    I agree...

    No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.
    Don't come after me for saying this, its not my opinion. But general opinion that I have observed from people who are not well informed(read majority of people). Lets focus on the main stream media in US, outside coverage is not that significant anyway.

    I think this red dot green dot thing is the silliest thing to be carping about. It appears that a SIGNIFICANT number of posts in all threads are about this red dot green dot stuff.

    Why do we care about this red/green dot nonsense? Does it really affect anything in the real world?

    Guys:
    Based on the June Bulletin, I will be filing my I485 in June.

    Now, I have H1-B(with my current company till Feb'2010 that I just got approved a month back.(not stamped in passport yet)

    -- Should I file EAD for myself ( I probably would want to change jobs after 180 days) ? Or is it better to be on H1-B.
    -- Should I file AP for both myself and my wife(she is on H4) ?

    Also, when I decide to change jobs using AC21 rule, is it better to tranfer
    H1-B to a new company or if I have EAD, how does that work ?

    Any inputs will be greatly appreciated..!!

    If I were you, I would apply for EAD and AP for spouse and self immediately. You never know when you may need it. Say, your company announces a merger and your entire department is wiped out and you have to leave before coming Friday. It would be almost impossible to find another employer who will send the new H-1B application before Friday. In such instances EAD will help to keep you in status. EAD card for spouse will allow her to apply for SSN and thus Drivers license. AP for wife will help to travel out of country after you have used EAD. So in short, I would apply for all the docs for all members of the family. This could result in spending couple of hundred dollars but will help secure peace of mind.

    Many folks on this forum are so excited that consulting companies are going to be affected by this bill. Many FTEs think they are safe and consulting companies going out of business will help them get their GCs faster. Wait and watch, such bills typically affects direct hiring companies more than consulting companies in the end.

    Remember who is proposing these bills. Durbin and gang. Do you think they are trying to liberate the employees from the clutches of "bad" employers. I don't think so.

    Many IV members has started seeing this anti-H1B bill as CIR 2009.
    We are such a pathetic community !

    I'm coming up with a letter that will address some of our issues. It will have simple content, point-wise.
    It will have
    5 Year GC, 10 Year Citizenship.
    Recapture of lost visas,
    How we can improve housing/job mkt.

    I may do it by evening. Can some of us help me in gathering some email addresses for people to contact. I can gather some. For Zoe Lofgren, I am not able to go to her site to send her an email, as it asks for zip code. Which Zipcode works for her, anybody..

    Till then can you please do us all a favor by bumping up this thread, as you do, we can pick up more members..

    Dont wait for a fruit to fall in your mouth on that day.. more chances for you to get struck by lightening.. better move from under the tree faster and buy a house..

    If a bad person who is going to fail a name check is already in the country, then name checks are not going to deter him from doing his thing. Just because a name check is pending without a GC means nothing to a potential bad guy.
    If a foreigner tries to become a governor or tries to join a govt agency he goes through a lot more special screening than just name checks. It should be up to the FBI to fail or pass a name check and all benefits should be revoked if the FBI fails a name check. This is going to be rare and there is no need to fight the battle for somebody who fails a name check (which is where your argument is so extremely stupid). It happens in other spheres too, sometimes people lose their jobs after many years if the company finds that you falsified information like degree etc.

    I am not going to stretch this discussion beyond this as it seems to me spiraling out of limits of reason. Of all the things you said to support your argument, the first part of your latest mail will kill any support you might get from any normal person. From your arguments I think may be you should change your name to "stupiddesi". YOu would even clear your namecheck easily; or may be not - too many of them ;-)

    Saimrathi, you are posting the same message on all threads. Anyway, I am sure some of the media will pick up the story and write about it. I think there are benefits from this campaign. The name Immigration Voice is out there. We may get more members of our community to join us and participate in future campaigns and we can learn from experience on how to carry out future campaigns, protests etc. We had to speak out in some way on what happened to us with the USCIS Visa Bulletin fiasco. I believe it was worth it for all these reasons.

    Guys this is a revision to the July Visa Bulletin. Meaning, even if the revision happens on July 29th to the July Visa Bulletin, it holds good for entire july.
    This is not August bulletin.

    Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
    If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.

    Pls let me know if my understanding is wrong

    You are right but only if DOS revises the bulletin. The more likely scenario is that DOS will send a notification to the USCIS that all visa numbers have been exhausted and then it will be upto USCIS to decide what to do. I that case USCIS will most likely accept all applications received up to that point- Same thing happened last month for EB-3 Other workers!

    I am EB2-I with a couple of US grad degrees (and same undergrad school as Rolling Flood, not that it matters to anyone except perhaps those who suppor the lawsuit). And I think this lawsuit is a bad idea because it is divisive and petty.

    There is an old Malayalam story that most people who went to school in Kerala would have read in their primary school classes. Two guys, Greedy and Jealous, pray to God. God appears and Greedy goes, "I just want double of what you give the other guy. All I want to be is to be ahead of him." Hearing this, Jealous says, "God, please make me blind in one eye."

    This lawsuit, like the story above, is a case of knifing others in the back, for no real gain. We should instead try to leverage IV's large membership for a common good, which is what has made IV successful so far.

    This is a very good question. When I was on H-1B visa, at that time, it can not be extended beyond 6 years. At that time, people will move to home country/Canada for 1 one year, plan to move to O visa if qualified, will try to regain time for out of US time etc. The argument was gaining strength that person should get green card before her/his 6 years are up. To make matter worse, H1 and H4 time was counted together.

    Now, rather than providing the long term solution of increasing the quota for green cards per year, EB based applicants were offered band-aid solution of extending H1 indefinitely beyond 6 years if labor is pending > 365 calendar days or I-140 is pending/approved. This was further sugar coated that if I-485 is not approved in standard processing time of 6 months, applicant can change GC job for same/similar classification. People were very happy with AC-21 and many thought (and they still think) that getting EAD is like a provisonal green card, as they can change job easily and employer can no longer "control" them.

    Now, since H1 can be extended beyond 6 years, the arguement for faster green card has become weaker. Reason is simple, since applicant can work for "green card sposoring" employer for infinite time, even if I-485 is not filed.

    In my opionion, ac-21 was a band-aid solution. Strangely enough, perople are still looking for more band-aid solutions.

    Well, as they say, history repeats itelf.

    I guess only a minority of people get stuck in name check ( unlike immigration portal forums , the FBI namecheck discussion thread doesn't move much) or may be that majority still in the 'waiting for receipt notice/FP' mode.
