We are travelling next month and our travel agent wisely suggested and booked tickets for us via frankfurt by air india. He knows that london is a problem especially when you are coming back on AP.
After reading thru the painful story of milind, I feel that I should never go thru london.

Why they need name check when they have finger print? Name can be change any time where as finger print cant be.

You can withdraw an existing 485 application once you get Receipt No. Just write a letter to USCIS asking them to withdraw your 485 application stating the reason for withdrawl.
If that's true, I hope they also accept the missing inital evidence, that is sent later, as long as the A# is provided.

Thank you for the reply.
I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

VO said visa approved, will receive in 7 days
Jan 18: received a call from the consulate, said the petition number on the application is incorrect, and I need to resubmit the approval notice with fresh DS 156/157 at the Bangalore VFS drop box.
Has anyone else been through the same situation?
I checked a copy of the original DS-156/157, and there was no place to enter receipt number. The only place I could see was where the VFS pre-screening guys enter this number manually (first page DS 156 top right corner).
If this is due to their mistake, I will be very angry and will convey this to the consulate general.

I am no Gandhi and don't want to be one. I am just a common man trying to make my ends meet. Only thing I know is that if you come before me in the line I am affected. It is not a DMV line where every one will get their License, it is a ration line where the items are limited.
Call it selfish call it any thing else but these are the facts after being in the USA for last 12 years and two different labors.
You are correct this is a selfish world. I support you. You are most welcome to go ahead with the lawsuit. I am EB3 and been here for 10 years and have no intention of porting to EB2. I will be most happy to see you get your GC.

I don't think you want to go into foreclosure. It will mar your credit report for sure, and it may be difficult for you to get another homeowners loan in the future.

Hi,
We have already made plans for our India trip. We will be leaving US on June 2nd. Can we apply 485 on June 1st and leave to India on June 2nd.
Will there be any complications around this.
As we will be returning in July, we are not sure if my PD will still be current by the time we return back.

I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences
01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that
02. Submit current dated EVL for your new employer. No issue. we can answer that
For my wife also asking for 2 evidences:

I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.
You can not change what had happened. They already found it.
And you did not do that in purpose and the dependant did not take any advantage during that period. So get a good lawyer and give proper explanation. Being out of status does not disqualify the application immediately. It depends on the explanation and the reviewer. There may be exceptions.

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. I guess we'll need to ADD to that number:
1. BEC stuck folks who could not file in July 07
2. PERM approvals starting August 07
to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.
If I have to guess-- (1) would be very less, may be 100-200 max
(2) around 5000 ( just a PUMA)
So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.
If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

I have seen some of your posts and looks like your the oldest waiting since the dates have been current. Are you considering filing WOM since you will be current for 4 months by Oct. What is lawyer saying? Although I have been just current for 12 days the wait seems forever so I understand how you must be feeling.
What did your senator/congressman say?
Where is your application TSC or NSC? If it is TSC, did you try to send email to streamline email address? I know you must have done everything. Also you can try to goto the local office and have them issue you a FP notice if they have expired. Maybe that will set things in motion since I know some IOs just want to issue another FP and not refresh the old one in their systems.

Just curious, how come there are some pending aplications in the year 2008 and 2009 where there were no VISA BULLETIN with those years. How they filed without Bulleting entries? Got point? or Am I missing some thing?
