This is a "do nothing" congress. They dont care about immigration reforms as this doesnt have immediate affects. Frankly i have no hope. Nothing is going to happen till summer of next year.

How to find out if our FBI finger print and IBIS checks are cleared?
I spoke to NSC IO yesterday and found out that my case is still waiting for security clearence. Does that mean they are waiting for my FP and IBIS clearance?
My case is EB2/Feb India and I-485 RD is 06/15/2007.

Our receipt date is 9/10. No FP notices yet. Got EADs and APs well in time.
I opened SR for myself on 10/11 and my wife on 10/16. Exactly after 45 days, today I got 2 letters from them. There is no logic in what I see in them. Here are they:
Response to my SR: Our review indicates that this case is actually within our processing time. We regret any misunderstanding.If you don't recv a decision or notice of other action within our current processing time, check our website or call cust service. All returned documents will be re-mailed.

Response to spouse's SR: The status of the service request is :
Biometrics must be taken at the ASC in your area. When an appt. becomes available you will be notified by mail when and where to report. Please allow 4 months to receive your appt for biometrics.
Finally the real twist ..... We had an infopass appt at Dallas center last week.The IO asked me the purpose of the visit and I had informed her about our cases. She looked at our cases and said that our files are not yet opened. I was confused and upon my request to explain in detail, she said our files were not assigned to anyone and are with TSC. She suggested me to call USCIS Natioanl Cust serv and ask them to send a request for the files to be opened. I have never come across/read such a scenario. I got further confused and was wondering how come we got EADs and APs when our files were not "opened". There was no clearcut answer for that. She advised me to call them and quote that we visited Infopass and they advised us to call USCIS asking our files to be opened. I am not sure if this works or not.
But the greatest relief came at the end of the appt ....both of us got cleared in the background check. I am assuming that background check and name check are one and the same. Friends,Correct me if I am wrong.She said as of Oct 18th, we were cleared.
Looking at all these things, I am not sure how the process is taking place !

Which state you are based in? If you are close to NJ, I know a doctor whoes turn around time was very very quick. You can speak to him in advance and arrange to get everything done quickly. He is very accomodative also. You can PM me if you are interested.

Thanks for your reply, there are a lot of conflicting reports from different sources so I wanted to be sure. Have you traveled in the past month or know of anybody who has come back without a transit visa through Frankfurt? The new Schengen visa rules are causing a lot of confusion. Thanks!

I checked with some of my colleagues and friends. They all have sent the letters, but most of them have not participated in this poll at the start. So I wouldnt get discouraged by smaller number of votes in it.

5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

Hispanic community has unity. EB Community has factured groups, each intenet on their narrow goals and aspirations. There is no use commenting on and comparing Hispanic comunity with legal community. they have delayed processing time so more people will file for premium processing and they earn more money. H1b quota is not filling up and all of a sudden processing time went from 2 to 6-7 months in 1 month. Because so many people ( h1 - h4 ) might be travelling in dec - jan season. Come back in feb - march and processing time will be again 2 months.

The law seems to have changes due to AC21, I don't think we can get any actual data of any one who got his GC after AC21 and has already converted to citizenship.
It would be really great if IV can contact USCIS and get an official guideline on this topic.

question 2) did both you and your spouses I485 cases receive RFE?
question 3) did both you and your spouses case have an LUD after RFE?
have you guys received the RFE notices and if yes, what is USCIS asking

2- RFE only for me at this point (online). Wife's still says "pendin at the location" but has soft LUDs
3- I got LUD after RFE

Do not care about the money now. Give 5k and file thro company. If you need any help from company for RFE or any other issue after filing gc then company will help for you. Because you are working for hourly paying 2 or 3k more than normal should be ok. Some of lawyers are charging more compared to normal
I guess most of the folks here are busy preparing to apply for 485. I have different problem here.
My employer's attorney is charging me outrageous fees of around $5000 to
apply for 485, AP and EAD for me and my spouse. This excludes USCIS fees. I work on hourly basis, so I should be taking care of immigration fees. My employer is not allowing me to file through another law firm.
Do I have any other options. How much do they charge usually.

Leave on good terms with your current employer. That will eliminate or at least minimize a headache associated with I-140 withdrawal. Employer is free to withdraw I-140 at any time and the USCIS cannot prohibit it. However, even if I-140 is withdrawn, your I-485 remains valid if you have a new employment offer. So no worries, just plan for it and act according to your gut feeling :)

There were 12144 unused visas in EB-4 and EB-5 category which also spilled over. You could argue that those visas spill over to EB-1, however EB-1 had usage of 36591 visas last year compared to maximum allocation of 40040 visas which meeans that EB-1 also had 3449 unused visas. This means that there was a spill over of 15593 visas just from EB-4,EB-5 and EB-1 category.
