Ok disclaimer first. I do work directly with employer and not a consultant.
I think there is an ongoing debate over it whether consultant companies should be allowed for H1b's and green cards or not. Let me be very honest. There are so many US employers who do not want to get into mess of H1b's but still want talent. These desi or videsi consultant firms feed on them and people like you and me searching for jobs. It is generated out of necessity on both ends.
There are some very very big consulting firms too and not to Mom and Pop Desi shops.
I feel for both sides and the real problem is to have multiple H1's and H1b's sitting on bench which is even worst. So either they hire and pay and make their responsibility to find job or don't file for H1b's

This appeared in todays Business Standard Newspaper in India. Atleast, the issue came up for discussion.

The United States today indicated that it was willing to consider setting up of a joint technical working group to address the issues coming in the way of finalising a totalisation agreement with India.
New Delhi, on its part, has made it clear that it is not agreeable to the US stance of linking the requirement for a social security net as a precursor to finalising the agreement. India also made clear that it was adopting a calibrated approach to further opening up of the retail and financial services sector.
Indians working in the US have to mandatorily contribute to social security benefits but are unable to repatriate the same when they leave the US, in the absence of a totalisation agreement between the two countries.
The issue was discussed at a meeting of US Under Secretary for International Trade Franklin Lavin and Commerce Secretary G K Pillai in the capital. Commerce ministry officials said the Indian side pointed out that New Delhi had signed totalisation agreements with countries like Belgium and France, which had not set any pre-conditions.
“It was pointed out that India, which is a developing country, effectively gives a grant of $500 million to the US in the absence of a totalisation agreement. The US has indicated that it will soon have a video conferencing on the matter with senior Indian officials,” an official said.
In response to the US demand for further opening up of the financial services sector, the commerce ministry pointed out that India was adopting a calibrated approach on the matter.
“It was pointed out that the Reserve Bank of India has finalised a road map for the gradual opening up of the sector by 2008,” an official said, adding that New Delhi raised the issue of absence of a level-playing field for financial institutions in the US.
“A foreign bank wanting to open more branches in India only needs to obtain the permission of the Reserve bank of India. However, an Indian bank wanting to open up branches in the US has to go through the American federal system and then a state regulatory system,” an official said.
Banks like State Bank of India and ICICI have long pending applications for opening more branches in the US.
India also raised the issue of extending protection to its traditional knowledge under the patent regime in the US.

Maybe USCIS thinks that our cases mayn't become approvable within the next 15 months. This is just my theory, because I see lot of people have got FP but with early PD's

I read through this proposed legislature and there is absolutely nothing to worry about.
your valid drivers license is clearly mentioned as one of the acceptable proof of legal status. you need to be arrested or there should be obvious reason to suspect ilegal presence for the law official to ask proof of legal status. Why is that of any concern? That is perfectly normal in a legal society. You dont have to walk around with your 797 or 94s all you have to carry is a valid drivers license. Even if you dont have a license you will be given a chance to proove your legal status or inother words the decision is not made on the spot.
Again for those unfortunate who are here ilegally this law might become an issue. But we might end up seeing inflation as a result of these crack downs. More industry particularly packing/agriculture might migrate oversees. Anyway we will wait and see.

we can argue both ways, democratic party was not rejected because of the economic mess, even today lot of voters are angry at bush for the mess, the issue here is WH is completely out of touch with the main street, why spend 2 years on health care when ppl dont have jobs to afford basic necessities, the less we talk about stimulus the better, ppl dont like someone who don't listen and arrogantly say what ever they do is for the good without showing any progress (hmmm, reminds me of bush but hell dint we vote for change?) or say voters are ignorant,
bush is not the whole problem, democrats are in the majority since 2006 and look at the deficits since then, wars costed US trillion dollars which is less than annual deficits under the current president, i agree he does not own the deficit problem completely but he dint help to fix it either, bush dint sign "glass-seagall" act which caused the whole mess in the first place, clinton was the one who pushed the initiative "housing to minorities" and his administration wanted to push it through freddie and fannie and the rest is history,

On a second note, it is easy to sit in any position and criticize the president (this applies to bush too) however, what this president is doing is far better in the long run for this country (if we decide to stay) than any other potential candidates.....
Also saw your wish of Obama loosing in 2012 - assuming he ran and his opponent will either be Sarah Palin or Newt Gingrich - just thinking of it gives me shivers! chills! cold! cough! and high fever! (if not more) I urge you to think twice before you wish for something.

While I do not condone all practices of these big companies: coz of them many ppl sitting in India will have a H-1 and may never come here but me and some of my friends who have been working hard as students here (doing B.S. from a very reputed school, that still doesn't help be cap exempt) shall likely be left out.
But, I do see racism in all this H-1B talk, lets face it: these are means to control (mostly) Asian immigration, I'm sure this wouldn't be an issue at all if H-1B was not the 'brown man's' visa to America.
PS: Just my 2 cents, no offense intended to anyone of any color.

I cannot imagine how educated illiterate IV members are. You think voting on some site will get the bill passed? I agree with Fresheb2 that this is a waste of time. You guys are only promoting some new site. This site will capture your email addresses and send you marketing material. If you read about the site owners, they are commerical companies and they seek to make profit from this site. Do not be fooled that someone will send your bogus votes to congress and the bill will be passed. The site only aims at generating awareness among US citizens about congress and bill. They probably got some grant or decided to make money off this idea and started this website.

Can you call up the customer service to know your status as to whether you are pre-adjudicated or not?
As per this everyone who got pre-adjudicated would be receiving their GC in FY2010. But, there are people from EB3I with PD as late as 2007 who got RFEs recently and got their cases pre-adjudicated( I am one of them even though my PD is March 2003 and when I called up NSC, they said my case was pre-adjudicated and waiting for a Visa number ).
With EB3I staying at 1 Nov 2001 when the new FY2010 quota starts in October doesnt match to what Ron Gotcher says.
Anyone have any opinion?

I am still waiting for FP notice, i got my EAD/AP/RD, for both of us.
It was filed @ NSC on July 6th, ---> CSC -----> NSC. I got my LUd on 09/21 last on our 485.

As long as the employer/employee relationship exists, nobody can't do anything. This is for sure.
Let me correct it.. I read somewhere that it is considered not a major problem if some one is out of status for less than 180 days cumulatively.

I have AP with visa expired.

It says:
- a valid residence permit or visa for the USA, Japan, and Canada
- An Airport Transit Visa is not required for holders of valid visa issued by

the USA irrespective of the travel destination.
I have a Canadian Visitor Visa. Do you think I will need Airport Transit Visa or I am reading it wrong?

I would say Ontario (Ottawa or maybe Toronto) is better compared to Quebec with regards to immigrants.
In Quebec, if you cant speak French, you are frowned upon. Yeah, yeah i can hear the Montrealers saying they speak both French and English, but the reality is that Quebec only likes people who are French. I heard some racist remarks while walking in the downtown, not uncommon. For some ignoramuses, every colored person is a "bangladeshi" and hurl racist abuses. I was very shocked to say the least...Isolated incident, but not uncommon.
Bottomline, if you wanna life like u had in the US, better Ontario than Quebec or even BC.

A lot of us can do and will do many things. Your argument does not stand ground. I dont ahave anything against this guy. I have a problem with the system that permits this activity. Because its not fair. By the way I seriously doubt this happens to people in my situation. This is typical of "desi consultant companies". So once again pontiff i dont have a grudge against this guy but the system that allows this to take place.

Sorry i updated under the wrong thread.
ours was a paper filed on July 2nd. Card was mailed on 08/07/08. Still waiting for it to make it to the mail box.
I have not recieved any FP notice yet. Surprising I also saw a soft LUD on AP when care production got ordered for EAD but no updates on AP or FP yet.
